The Electrical Safety Standards in the Private Rented Sector (England) Regulations 2020 require private landlords to ensure that the electrical installation in their rental property is inspected and tested at least every five years, or at each change of tenancy. The inspection produces an Electrical Installation Condition Report (EICR), which must be provided to new tenants before they move in, to existing tenants within 28 days, and to the local authority within 7 days if requested.
If the EICR identifies any C1 (dangerous) or C2 (potentially dangerous) defects, these must be rectified within 28 days. The landlord must obtain written confirmation from the electrician that the remedial work has been carried out and provide this to the tenant and local authority. Failure to comply with the regulations can result in a civil penalty of up to £30,000. Local authorities have enforcement powers and can serve remedial notices where landlords do not comply.
In addition to the EICR requirement, landlords must ensure that carbon monoxide alarms are installed in any room containing a gas, oil, or solid fuel combustion appliance, and smoke alarms on each floor of the property. Under the Smoke and Carbon Monoxide Alarm (Amendment) Regulations 2022, landlords must ensure alarms are in working order at the start of each new tenancy.
For HMO (Houses in Multiple Occupation) landlords, local authority licensing conditions may impose more stringent electrical requirements, including specific socket numbers, fire alarm systems, and emergency lighting.
